In India, IPRs are governed by specific legislations:

• Patents: Governed by the Patents Act, 1970 (as amended). Protects inventions that are novel, involve inventive steps, and are industrially applicable. 
• Trademarks: Governed by the Trade Marks Act, 1999. Protects brand names, logos, slogans, and distinctive signs. 
• Copyright: Governed by the Copyright Act, 1957. Protects literary, artistic, musical, cinematographic, and computer software works. 
• Industrial Designs: Governed by the Designs Act, 2000. Protects the aesthetic or ornamental aspects of products. 
• Geographical Indications (GI): Governed by the Geographical Indications of Goods (Registration and Protection) Act, 1999. Protects goods linked to their geographical origin (e.g., Darjeeling Tea, Banarasi Saree). 
• Plant Varieties: Governed by the Protection of Plant Varieties and Farmers’ Rights Act, 2001. 
• Semiconductor Integrated Circuits Layout Designs: Governed by the Semiconductor Integrated Circuits Layout-Design Act, 2000.
• Trade Secrets: No specific legislation—protected through contracts, common law principles, and equitable remedies.

• Encourages innovation and creativity in line with India’s Make in India and Startup India initiatives. 
• Provides exclusive rights to creators, fostering R&D and business growth.
• Enables monetization through licensing, franchising, and technology transfer.
• Protects traditional knowledge and indigenous products via Geographical Indications.
• Ensures legal remedies (injunctions, damages, seizure of infringing goods) in case of infringement under Indian statutes.

• Patents: File at the Indian Patent Office (IPO) under the Patents Act, 1970. International protection via direct route or PCT. 
• Trademarks: Apply with the Trade Marks Registry under the Trade Marks Act, 1999. Global protection through the direct route or Madrid Protocol.
• Copyright: Automatic upon creation under the Copyright Act, 1957, though registration is recommended for evidence.
• Designs: Apply at the Design Wing of IPO under the Designs Act, 2000.
• GI: Apply for registration under the GI Act, 1999.
• Plant Varieties: Register with the PPVFR Authority.
• Trade Secrets: Protect via confidentiality agreements, NDAs, and employment contracts.
